Dungeon Universe (“game”, ”service”, ”application”) is a virtual game application which incorporates Enjin blockchain technology. It combines cutting-edge Enjin blockchain, real-time graphics, multiplayer video game and decentralized financial technology, built into the game to participate in, trade and sell non-fungible in-game tokens (NFTs) in the market.

Before using the application or site, you should review these Terms of Use, and also read the Dungeon Universe Privacy Policy.

hateful speech and offensive language

Hateful speech and offensive language will not be tolerated in Dungeon Universe community. This includes, but is not limited to, using racist, sexist, homophobic, or discriminatory language or slurs in any game-related communication such as in-game chat, discord or any other platform. Harassment, bullying, and threats will also not be tolerated.

Any violations of this policy may result in the temporary or permanent ban of your game account. By participating in Dungeon Universe community, you agree to respect the rights and dignity of others and to conduct yourself in a manner that reflects positively on our community as a whole. We strive to provide a welcoming and enjoyable gaming experience for all players and expect all our community members to contribute to this goal. No exceptions.

Violations of this policy may result in the permanent suspension of the involved account, without warning and without a right to any refund. In addition, we reserve the right to take any other action we deem appropriate.

bugs & exploits

Any non-human behavior in our game will not be tolerated. This includes, but is not limited to, using third-party software, hardware or hacks to gain an unfair advantage, manipulating game mechanics, and exploiting bugs or glitches.

Such actions undermine the integrity of the game and disrupt the fair play of all players. If you are caught engaging in non-human behavior, you will face severe consequences, including permanent bans from the game.

We encourage all players to report any suspicious activity to our support team. Let’s work together to create a fair and enjoyable gaming experience for everyone.

Exploiting game bugs and glitches for personal gain is strictly prohibited. This includes, but is not limited to, using known bugs or glitches to gain an unfair advantage in the game, duplicate items, or manipulate the game’s economy.

Few examples include, but is not limited to:

– killing a mob when he is not attacking back

– using consumables that are not being used

– using economy bugs (items sold at higher prices then being obtained or any other action that allows you to gain more gold then intended including auction house)

Account sharing, trading & selling

Account sharing and selling are strictly prohibited in our MMORPG game community. This includes sharing or selling access to your game account with other players or third-party entities.

By participating in our game community, you agree that your account is for your personal use only and that you will not share or sell access to your account with anyone else. It is also important to keep your account security to avoid unauthorized access.

There is also limit of 1 Ethereum wallet per account.

Violations of this policy may result in the permanent suspension of the involved accounts, without warning and without a right to any refund. In addition, we reserve the right to take any other action we deem appropriate.

in-game gold selling

Selling in-game gold for real money is strictly prohibited in Dungeon Universe. This includes, but is not limited to, using third-party websites, transactions with other players, or any other methods to sell in-game gold for real money or other forms of currency including cryptocurrency.

You agree that in-game gold is for your personal use only, and that you will not sell or exchange it for real money or any other forms of currency. We take this rule very seriously and we will actively enforce it and do random checking of players gold amount deviations.

multiboxing / dualboxing

Running two clients at the same time and controlling them at the same time, using any third-party software or hardware and/or macros, is strictly prohibited. This also means that having multiple accounts registered under 1 person is also prohibited.

Violations of this policy will result in the permanent suspension of all involved accounts, without warning and without a right to any refund. In addition, we reserve the right to take any other action we deem appropriate.

scamming

Scams or any intent to scam other players is strictly prohibited in Dungeon Universe. This includes, but is not limited to, falsely advertising or misrepresenting items or services, phishing, and any other forms of deception or fraud.

The Game

Dungeon Universe is a free to play game. Everyone can download the game free of charge and starts playing.

We decided for free to play model to extend the audience and want to give players a chance to earn rare and limited NFT’s.

Our goal is to blend the MMORPG genre with blockchain technology, using the NFT’s as the limited items that have certain value and offer increase benefits over in-game virtual items or offer cosmetic improvements to distinguish yourself from the rest.

Important points

The Enjin blockchain technology proves to provide a secure gaming experience.

Non-fungible tokens (NFTs) received in Dungeon Universe can create an economy that mimics the real-world assets and property.

Multiverse is a collective gaming reality created by integrating a collection of blockchain assets with multiple games.

In other words, a gaming multiverse is a collaborative gaming project, where multiple game developers agree to use the same shared, decentralized database for some (or even all) of their in-game assets.

This enables gamers to utilize a multiverse asset in every game that is a part of a specific gaming multiverse (e.g., if a player owns a sword in Game A, they will also own it and can use it in Game B).

We want to provide the best support possible and we will always do our best to answer all of your questions.

Therefore, we can offer several support channels to help you with the question that you might have in relation to Dungeon Universe. It is very likely that the inquiry may already be answered in the past so please use the search function for the fastest answer.

Fees and Payment

If you decide to buy, exchange or interact with non-fungible tokens (NFT-s) in game or with other users through the game, all crypto transactions you make will be carried out within Enjin Network or Ethereum network. We have no overview or control over such payments or transactions, and we do not have the ability to reverse any transactions. You agree that we will not be responsible to you or any third party for any claims or damages arising out of any transaction you make through the game or any other transaction you make through Enjin or others.

With every transaction there might be transfer fee’s taken by Dungeon Universe in order to support the free to play model of the game. The fees are searchable on https://enjinx.io/ under the specific NFT in question.

Additionally, there is account subscription option available for players in Dungeon Universe game. This account subscription offers in-game benefits for users and is completely optional. In case of user account termination, Dungeon Universe is not obligated to provide a refund of any purchase for any reason on any unused subscription time, items or any other value that the user paid. Even in case the account was closed voluntarily.

You accept that any applicable taxes in connection with the use of the account, NFT and in-game purchases shall be supported by you.

We have no liability to you or to any third party for any claims or damages that may arise as a result of any transactions that you engage while using our game or website.

Ownership & PROHIBITED ACTIVITIES

You acknowledge and agree that, unless otherwise stated, we own all legal rights, materials, interests, titles, in the game Dungeon Universe, as well as all intellectual property rights. Graphics visual interfaces, software, methods, design, information, systems, computer code, services, organization, composition, content, code, data, and all other elements of the application (collectively the “Dungeon Universe Materials”) are owned by Dungeon Universe and are protected by copyright, patent and trademark laws, international conventions, other relevant intellectual property and property rights and applicable laws. All Dungeon Universe materials are the copyrighted property of Dungeon Universe or its licensors, and all trademarks, service marks, and trade names contained in Dungeon Universe materials are owned by Dungeon Universe or its licensors. Except as expressly stated otherwise, your use of the Application does not transfer any ownership or other right to any content, code, data, or other material accessible in application or through the game. Dungeon Universe reserves all rights in and to Dungeon Universe Materials not expressly granted to you in the Terms of Use. For the sake of clarity, you understand and agree:

that any “purchase” of a Dungeon Universe NFTs, whether through the game or otherwise, does not give you any right or license to or in the Dungeon Universe Materials that are not expressly included in these Terms; and
that you have no right to reproduce, distribute or use any of the elements of the Dungeon Universe Materials (including, but not limited to, our technical copyrights and related design tokens) without our prior written permission.

You can submit comments, bug reports, ideas, or other comments about the Dungeon Universe game, including, but not limited to, how the game can be improved (collectively, “Comments” or “Feedback”). By submitting comments/feedback, you agree that we are free to use such comments at our discretion and without further compensation to you and to share those comments with third parties. You hereby grant us a perpetual, irrevocable, non-exclusive, worldwide license under all necessary rights, so that we can record and use your comments/feedback for any purpose.

You agree that you are responsible for your own behavior when accessing or using the game and for all consequences resulting therefrom. You also agree to use the game only for lawful, reasonable purposes and in accordance with these Terms and any applicable law or regulation. As an example, and not by way of limitation, you must not allow any third party to:

spread material of a destructive or fraudulent nature, corrupted files, hoaxes, viruses, Trojans, worms, bugs or other;
impersonate another person (through the use of an email address or otherwise);
upload, post, transmit, or otherwise make available through the game any content that infringes any party’s intellectual property rights;
use the game to violate the legal rights (such as privacy and disclosure rights) of others;
engage in, promote or encourage illegal activities (including but not limited to money laundering);
be a part of any gambling activities related to Dungeon Universe NFT’s or virtual items
interfere with the use of the game by other users;
operate the game for unauthorized commercial purposes;
modify, adapt, translate or reverse engineer any part of the game;
remove all copyright notices, Trademark or other proprietary rights contained in or on the game or any part thereof;
reformatting or framing any portion of the game;
post content in the game, website or other communication channels that contains hateful or violent content, or contains any other material, product or service that violates or incites conduct against any criminal law, other applicable law, or third-party rights;
use a robot, spider, site search / retrieval application, or other device to retrieve or index any portion of the game or content published in the game, or to collect information about its users for unauthorized purposes;
create user accounts in an automated manner or under false or fraudulent pretexts; contained in or on the application or any part thereof.

Multiple clients (“DUAL-BOXING”) and multiple accounts

If we detect multiple clients from the same person or a single person having multiple accounts, your account(s) may be subject to temporary or permanent termination.

This behavior is ruining the game experience for the rest of the players playing our game and we will take our best efforts to reduce such activities.

Termination

You can terminate these terms at any time by terminating your account in the game and ceasing your access and use of the game. You will not receive any refund if you cancel your account or otherwise terminate these terms. You agree that, we may for any reason, terminate these Terms and suspend and/or terminate your account from using the application. You also agree that any suspension or termination of your access to the game may occur without notice and that we will not be liable to you or any third party for any such suspension or termination.

If we terminate these Terms or your access to or use of the enforcement due to your breach of these Terms or any suspected fraudulent, abusive or illegal activity, termination of these Terms will be in addition to any other remedies we may have under law or in equity. In the event that you or us terminate or expire these Terms, you may no longer have access to information that you have published in the game, or that relates to your account, and you acknowledge that we have no obligation to maintain information in our databases or transmit this information to you or a third party. Termination of these terms is in addition to any other remedies we may have by law or in equity.

Disclaimer of liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOU ACCESSING AND USING THE APPLICATION IS AT YOUR SOLE RISK AND THAT THE APPLICATION IS PROVIDED “AS IS” AND “AS AVAILABLE” AND MAY CONTAIN SOFTWARE BUGS AND DEFECTS.

WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, DUNGEON UNIVERSE, OUR SUBSIDIARIES AND LICENSORS DO NOT WARRANT THAT:

YOUR ACCESS OR USE OF THE GAME WILL MEET YOUR REQUIREMENTS;
YOUR ACCESS TO OR USE OF THE GAME WILL BE UNINTERRUPTED, TIMELY, SECURE OR FREE FROM ERROR;
THE USAGE DATA PROVIDED BY THE GAME IS CORRECT;
THE GAME OR ANY CONTENT, SERVICES, OR FEATURES MADE AVAILABLE ON OR THROUGH THE GAME ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS;
THAT ANY DATA THAT YOU DISCLOSE WHEN YOU USE THE GAME OR WEBSITE WILL BE 100% SECURE;
YOUR PERSONAL DATA THAT YOU PROVIDED, WILL BE SECURE FROM UNAUTHORIZED ACCESS OR THIRD-PARTY ACTIVITIES, INCLUDING, BUT NOT LIMITED TO, THE USE OF VIRUSES, PHISHING, BRUTEFORCING OR OTHER MEANS OF ATTACK AGAINST THE GAME, WEBSITE OR OUR SERVERS.

YOU ACCEPT THE SECURITY RISKS OF PROVIDING INFORMATION AND TRADING ONLINE ON THE INTERNET AND AGREE THAT WE ASSUME NO LIABILITY FOR SECURITY BREACHES IF NOT OUR GROSS NEGLIGENCE.

WE WILL NOT BE RESPONSIBLE OR LIABLE TO YOU FOR ANY LOSSES YOU INCUR AS THE RESULT OF YOUR USE OF THE ENJIN BLOCKCHAIN NETWORK OR AN ELECTRONIC WALLET, INCLUDING BUT NOT LIMITED TO ANY LOSSES, DAMAGES OR CLAIMS CAUSED BY:

USER ERROR;
FAILURE OF SMART CONTRACTS OR OTHER IMPROPERLY CONSTRUCTED TRANSACTIONS;
SERVER FAILURE OR LOSS OF DATA;
CORRUPTED OR CHANGED WALLET FILES;

UNAUTHORIZED ACCESS OR THIRD-PARTY ACTIVITIES, INCLUDING, BUT NOT LIMITED TO, THE USE OF VIRUSES, PHISHING, BRUTEFORCING OR OTHER MEANS OF ATTACK AGAINST THE GAME, OUR SERVERS, ENJIN BLOCKCHAIN NETWORK OR AN ELECTRONIC ENJIN VALLET.

ALL TRANSACTIONS ARE RECORDED IN THE DECENTRALIZED BOOK WITHIN THE ENJIN PLATFORM. WE HAVE NO CONTROL OF CLARITY AND MAKE NO WARRANTIES OR PROMISES REGARDING THE FUNCTIONALITY OF THE ENJIN BLOCKCHAIN AND / OR THE EXECUTION OF CONTRACTS AND / OR SMART TRANSACTIONS.

Limitation of Liability

DUNGEON UNIVERSE IS NOT AND WILL NOT BE LIABLE FOR ANY DAMAGES, INCLUDING INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY, INCIDENTAL, CONSEQUENTIAL OR SIMILAR DAMAGES (INCLUDING LOSS OF DATA, REVENUE, PROFITS, OR USE), ARISING OUT OF OR RELATING TO DUNGEON UNIVERSE GAME IN THIS EARLY ACCESS STATE, INCLUDING THE USE OR INABILITY TO USE THE DUNGEON UNIVERSE GAME IN EARLY ACCESS (TESTING) STATE, EVEN IF SUCH PARTY HAS BEEN PREVIOUSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

YOU ACKNOWLEDGE AND AGREE THAT WE HAVE MADE THE APP AVAILABLE TO YOU AND ENTERED INTO THESE TERMS IN RELIANCE UPON THE WARRANTY DISCLAIMERS AND LIMITATIONS OF LIABILITY SET FORTH HEREIN, WHICH REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK BETWEEN THE PARTIES AND FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN US. WITHOUT THESE RESTRICTIONS, WE CANNOT PROVIDE THE GAME TO YOU.

Blockchain technology & Cryptocurrency Liability

THE WHOLE REGULATORY ASPECT OF BLOCKCHAIN AND CRYPTOCURRENCY IS STILL UNCERTAIN AND BRINGS MANY QUESTIONS TO THE LOCAL AND GLOBAL AUTHORITIES. AS WE WILL DO OUR BEST IN TRYING TO INTRODUCE THESE TECHNOLOGIES IN THE GAMING WORLD, THERE MIGHT STILL BE RISK CONNECTED WITH IT. THAT SAID, WE CANNOT GUARANTEE YOU THAT WE WILL BE ABLE TO IMPLEMENT ALL OF THE BLOCKCHAIN TECHNOLOGIES INTO OUR GAME, IF WE FACE ANY REGULATORY ISSUES THAT ARE PREVENTING US FROM PROVIDING THE SERVICES AND FEATURES PLANNED. IN THAT CASE WE ARE NOT LIABLE FOR ANY DAMAGES, INCLUDING INDIRECT, PUNITIVE, SPECIAL, EXEMPLARY, INCIDENTAL, CONSEQUENTIAL OR SIMILAR DAMAGES (INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA, REVENUE, PROFITS, OR USE), ARISING OUT OF OR RELATING TO DUNGEON UNIVERSE GAME IN THIS EARLY ACCESS STATE.

Assumption of risk

You agree and acknowledge each of the following:

The Dungeon Universe game is still in early access phase.
Dungeon Universe is not responsible for any blockchain transactions.
There are still technically difficulties with blockchain technology adoption in the gaming industry in relation to quality, stability and security of blockchain code implementation.
Blockchain NFT prices are extremely volatile. We cannot guarantee that buyers of NFT’s or other items will not lose money.
You are solely responsible for determining what taxes, if any, may be applicable to your NFT related transactions. Dungeon Universe is not responsible for determining the taxes that will apply to your transactions or profit.
There are risks associated with using an internet-based currency, including, but not limited to, hardware, software and internet connections, the risk of introducing malware, and the risk of third parties gaining unauthorized access to information stored in your wallet. You accept and acknowledge that Dungeon Universe is not responsible for any communication errors, interruptions, errors, distortions or delays that may occur in the use of the Enjin network, regardless of the cause.
A lack of public use or interest in creating and developing Dungeon Universe could have a negative impact on the development of the game and ecosystem and thus the usefulness or potential value of the NFT’s and speed of the development.
The regulatory system for blockchain technologies, cryptocurrencies, and tokens is uncertain, and new regulations or guidelines can have a significant impact on the evolution of the Dungeon Universe, and therefore the ability to develop the game in a fully functional way.
Upgrades on Enjin platform or a change in the way any transactions are confirmed or API calls are made on the Enjin platform can have an unintended negative impact on our game using the Enjin platform.

INDEMNITY

You agree to indemnify, defend and hold Dungeon Universe and its subsidiaries, affiliates, officers, agents, employees, advertisers, licensors, suppliers or partners harmless from any claim, demand, damages or other losses, including reasonable attorneys’ fees, asserted by any third-party resulting from or arising out of your use of the Service, or any breach by you of these Terms of Service, however, the foregoing does not apply if the infringement of rights is not attributable to your intentional or negligent behavior. Including:

your improper use of the game;
your breach of any applicable law, rule, or regulation relating to your access or your use of the game; or
your breach of our privacy policy. You agree that Dungeon Universe has control over the defense or settlement of such claims.

Dungeon Universe game or website may contain links to websites operated by third-parties. Again, we do not own or operate those other (third-party) websites. We provide these links to you as a convenience, or other users might be posting these links as user-provided content. Use these links and the corresponding external websites at your own risk.

We don’t control the linked sites, and we’re not responsible for the content available there. Such links don’t imply our endorsement of info or material on any other site, and we disclaim all liability with regard to your access to and use of such linked websites.

Changes to the terms

We deserve right to modify these Terms of Use from time to time at our sole discretion. If changes are made to this Terms of Use, the changes will be announced by posting on the website. Please check these Terms of Use regularly for changes. Any changes to the Terms will apply from the date they are made and your continued access or use of the game after the Terms have been updated will constitute your binding acceptance of the updates. If you do not agree to the revised Terms of Use, you may not use game or website.

Children and legal age

The Dungeon Universe Game or website is not intended for anyone under the age of 18. The game shouldn’t be played if you are less than 18 years old. Although we want to offer our game to as many people as possible, there is minor fictional violence included in the game, due to its design and graphic style.

Additionally, the use of blockchain technology and its features must also be used with highest caution and security measures, as the technology is just evolving and there are a lot of scams and imposters.

Should we actually learn that we have collected personal data from persons under the age of 18, we will delete it immediately, unless we are legally obliged to store this data.

Privacy Policy

Please see our Privacy Policy and read carefully, as we describe how we collect, use, store and disclose your personal data.

Dispute resolution; Arbitration

These Terms must be interpreted, governed and construed in accordance with Dungeon Universe exclusive choice of law principles. If a dispute arises out of or relating to these Terms, it must be subject to the exclusive jurisdiction of the courts, which location and venue is provided by Dungeon Universe and each party hereby consents to the jurisdiction and venue of such courts.

CLASS ACTION WAIVER

Both parties agree that any arbitration shall be conducted in their individual capacities only and not as a class action or other representative action, and the parties expressly waive their right to file a class action or seek relief on a class basis. YOU AND DUNGEON UNIVERSE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. If any court or arbitrator determines that the class action waiver set forth in this paragraph is void or unenforceable for any reason, or that an arbitration can proceed on a class basis, then the arbitration provision set forth above shall be deemed null and void in its entirety and the parties shall be deemed to have not agreed to arbitrate disputes.

Content standards

The following content standards (“Content Standards”) apply to any and all User Contributions and use of Dungeon Universe. You are responsible for your own conduct and communications and for any consequences thereof. User Contributions must in their entirety comply with all applicable federal, state, local and international laws and regulations. Information submitted by you must be correct and avoid language and content which may be regarded as inappropriate by other users. Without limiting the foregoing,

User Contributions must not:

contain any material which is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory or otherwise objectionable;
promote sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
infringe any patent, trademark, trade secret, copyright or other intellectual property or other rights of any other person;
violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms of Use and our Privacy Policy;
be likely to deceive any person;
promote any illegal activity, or advocate, promote or assist any unlawful act;
cause annoyance, inconvenience or needless anxiety or be likely to upset, embarrass, alarm or annoy any other person;
impersonate any person, or misrepresent your identity or affiliation with any person or organization;
involve commercial activities or sales, such as contests, sweepstakes and other sales promotions, barter or advertising; or
give the impression that they emanate from or are endorsed by us or any other person or entity, if this is not the case.

Defamation

You agree not to belittle or criticize Dungeon Universe or its affiliates or their respective activities and we undertake not to publicly diminish or criticize you.

Refunds

Purchases of any services, NFT’s or subscriptions are final and non-refundable. We ask that you keep good records of your receipts at all times, and that you double check before making any purchases. Your money is your responsibility.

Due to the irrevocability of the blockchain and our lack of control over users’ assets, we are unable to offer any refunds on purchases.

There are no third-party beneficiaries of these terms. The parties are independent contractors and nothing in these terms constitutes an agency, partnership or joint venture.

The language in these terms will be interpreted according to its proper meaning and not solely for or against any party. You may not assign any of your rights or obligations under these Terms, by law or otherwise, without our prior written consent. We may, at our sole discretion, assign our rights and obligations under these Terms to an affiliate or in connection with an acquisition, sale or merger.

If any part of these Terms is found to be invalid or unenforceable, that part will be construed in accordance with applicable law and the remaining parts will remain in full force and effect.

Our failure to enforce any provision of these Terms will not constitute a waiver of that provision or the right to enforce that provision.

We are not and will not be liable for any failure or delay in the performance of our obligations arising out of conditions beyond our control, including, but not limited to: government measures, acts of terrorism, earthquakes, fires, floods, natural disasters, labor conditions, power outages, internet interruptions, or acts or omissions of third parties.
